Prince Rare Tracks
We knew it would happen. A year after Prince died, in shocking fashion, from an accidental overdose of the powerful opioid fentanyl, new material is starting to trickle out. Or, rather: it’s trying. The particular batch of material that surfaced this week, timed to the first anniversary of the star’s death, came in the form of an EP titled “Deliverance,” which consists of one full-length song (the title track) and four fragments stitched together into a mini-opera. The provenance of “Deliverance” is somewhat murky.
The producer and engineer Ian Boxill, who worked with Prince on his “3121” and “Planet Earth” albums, in 2006 and 2007, respectively, and whose credits also include albums by Public Announcement, Bizzy Bone, and Tupac (the last, tellingly, also posthumous), supposedly co-wrote the songs on “Deliverance” during that period and, over the course of the last year, completed them and prepared them for release. Boxill did not, perhaps, prepare for the accompanying legal turbulence. Shortly after the announcement of the EP—which was to be distributed by Rogue Music Alliance, a label that mostly handles Christian music—Paisley Park and Prince’s estate descended upon Boxill, claiming that he does not own the recordings, that any work he did with Prince was done with the understanding that Prince would retain full ownership, and that the songs could not be sold. A statement explains the matter, along with implications of a nefarious motive: “Mr. Boxill maintained copies of certain tracks, waited until after Prince’s tragic death, and is now attempting to release tracks without the authorization of the Estate and in violation of the agreement and applicable law.” Boxill has not responded to the suit yet, but, in promotional materials for the release, he told a slightly different story, one that focussed on the fact that Prince began working on these songs when he was not signed to a major label, and that it was always his wish to find a way to circumvent, or at least supplement, traditional distribution. Earlier this week, a judge temporarily blocked the release of the songs and scheduled a May 3rd hearing. This is a knot that is not easy to untangle, and it is only the first of many when it comes to the supervision and distribution of Prince’s vault material.
